Welcome to Digiartor ("Digiartor," "we," "us," or "our"), a browser-based digital art and graphic design platform accessible at Digiartor.com (the "Platform" or "Service"). These Terms of Service ("Terms") govern your access to and use of the Platform. By creating an account, accessing, or using Digiartor in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About Digiartor

Digiartor is a browser-based digital art and graphic design tool that allows users to create professional designs directly from a web browser without the need to download or install any software. Using the Platform, users can create a wide range of design assets, including but not limited to:

Business Cards, Logos, Flyers, Posters, Brochures, Restaurant Menus, Price Lists, Product Catalogs, Invoices, and Letterheads
Invitation Cards, Wedding Invitations, Birthday Invitations, Greeting Cards, and Thank You Cards
Gift Certificates, Coupons, Employee ID Cards, Name Badges, Bookmarks, Product Labels, Shipping Labels, and Stickers
Social media assets including Instagram Posts, Instagram Stories, Facebook Posts, Facebook Covers, Pinterest Pins, YouTube Thumbnails, LinkedIn Banners, X (Twitter) Headers, Blog Featured Images, and Website Banners
Planning and productivity templates such as Calendars, Daily/Weekly/Monthly Planners, To-Do Lists, Checklists, Habit Trackers, Expense Trackers, Budget Planners, Meal Planners, Workout Planners, and Reading Logs
Educational and lifestyle content such as Chore Charts, Classroom Worksheets, Flash Cards, Word Search Puzzles, and Coloring Pages
And other design categories that may be added to the Platform over time

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use Digiartor independently. If you are between 13 and the age of majority, you may use the Platform only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

3. Account Registration

3.1 Creating an Account

You may create a Digiartor account by:

Registering with a valid email address and a password of your choice; or
Using Google One Tap Sign-In to register and log in.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to keep it up to date.

3.2 Account Deletion

If you wish to delete your account, you must visit the "Contact Us" page on the Platform and submit a request. Upon receiving a valid deletion request:

Your account will be immediately locked for a period of 30 days.
If no further action is taken, the account and associated data will be permanently deleted after the 30-day period.
If you change your mind during the 30-day lock period, you may submit another message via the Contact Us page requesting reactivation, and your account will be restored.

Once the 30-day period has elapsed and deletion is finalized, account data cannot be recovered.

4. User-Created Designs

4.1 No Copyright or Watermark Restrictions on Templates

Designs created using Digiartor's templates and tools carry no copyright claims and no watermarks imposed by us. You are free to download, use, and distribute the designs you create.

4.2 Commercial Use and Ownership

You are fully permitted to sell designs you create on the Platform, whether on Digiartor or anywhere else, without paying any royalty to us and without any obligation to credit Digiartor.

4.3 Unlimited Designs and Sharing Permissions

You may create an unlimited number of designs on the Platform. For each design you create, you may choose to allow or disallow other users from reusing your template. This permission setting is controlled by you at your discretion.

4.4 Responsibility for Content and Images

You are solely responsible for ensuring that any images, fonts, graphics, or other assets you upload or incorporate into your designs are copyright-free or royalty-free, and that you hold the necessary rights or licenses to use them. Digiartor does not pre-screen user-uploaded content for copyright compliance.

Important: If Digiartor receives a valid complaint regarding copyrighted material used in a design, or otherwise discovers unauthorized use of copyrighted content, the responsible user's account will be permanently suspended, and all designs associated with that account will be removed from the Platform, without prior notice.

5. Cost of the Service

Digiartor does not charge users any fee, in any form, for creating designs on the Platform.

6. Third-Party Services

6.1 Analytics and Tracking

Digiartor uses third-party services to track website traffic and user behavior on the Platform, in order to improve functionality and user experience. Please refer to our Privacy Policy for details on the specific tools used and the data collected.

6.2 Advertising

Digiartor displays advertisements through third-party advertising services as a means of generating revenue to support the free operation of the Platform.

6.3 Affiliate Marketing

Certain links on the Platform may be affiliate links. If you click such a link and make a purchase, you will not be charged any additional fee; however, Digiartor may earn a small commission or profit from the transaction.

7. Platform Rights

Digiartor reserves the right, at its sole discretion and without prior notice, to:

Add new features or services to the Platform;
Remove or discontinue any existing feature or service;
Suspend or terminate any user account;
Remove any design from the Platform;
Modify or edit any existing design hosted on the Platform;
Promote or feature any user-created design on any platform, medium, or channel.

8. Prohibited Conduct

When using Digiartor, you agree not to:

Upload or create designs containing content that is unlawful, defamatory, obscene, hateful, or infringing on the rights of any third party;
Use the Platform to create content that violates applicable copyright, trademark, or intellectual property laws;
Attempt to interfere with, disrupt, or gain unauthorized access to the Platform, its servers, or related systems;
Use automated means (bots, scrapers, etc.) to access or interact with the Platform without our prior written permission;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

9. Intellectual Property of the Platform

The Digiartor Platform itself — including its software, design tools, interface, branding, and underlying technology (excluding user-generated designs and content) — is the property of Digiartor and its founder and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Digiartor's branding, trademarks, or platform technology outside of your normal use of the Service.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. Digiartor does not guarantee that the Platform will be uninterrupted, error-free, or completely secure. Digiartor is not responsible for verifying the legal rights of any user-submitted content, and is not liable for any copyright or intellectual property disputes arising from designs created by users.

11. Limitation of Liability

To the fullest extent permitted by law, Digiartor and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of, or inability to use, the Platform, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Digiartor, its founder, and any affiliated parties from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your infringement of any third-party rights, including intellectual property rights, through content you upload or designs you create.

13. About the Founder

Digiartor is founded by Srikant Kumar Padhi, a B.Tech graduate with over 15 years of freelance experience across Graphic Design, Digital Art, Full Stack Web Development, and Full Stack App Development, as well as professional blogging. Digiartor was created to give people an easy, accessible way to create design art and graphics for any purpose, with the freedom to use and sell their work without sharing royalties or crediting the Platform.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, features, or for legal and regulatory reasons. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
